This Privacy Policy describes how Social Playlist X collects, uses, discloses and protects personal information when you visit socialplaylistx.com, contact us, or apply for creator funding through our referral service.

Important facts about SPX

  • SPX is a white-label introducer and broker.
  • SPX is not a funding provider, does not provide advances, and does not hold or control catalogs or channels.
  • SPX is never the counterparty on any funding agreement. Funding is provided by third-party funding partners named in Section 1.
  • The funding partner is the counterparty on all funding paperwork.
  • SPX charges creators a platform usage fee for its qualification and referral services — the only fee a creator pays to SPX. The fee schedule is set out in the SPX Terms of Use or the applicable service agreement. See Section 5.
  • SPX separately receives a referral commission from the funding partner when a referral results in funding. This commission does not reduce the creator's advance or come out of the funded amount. See Section 5.
  • All funding timelines, offers and terms are set by the funding partners, not by SPX.

Please read this policy carefully. By using this website or submitting an application, you acknowledge this Privacy Policy. If you do not agree with it, please do not use the website or submit personal information through it.

1.Who We Are and What This Policy Covers

Social Playlist X ("SPX") is a white-label introducer and broker for creator funding. SPX markets creator funding, reviews and qualifies applications, and refers qualified applicants to third-party funding partners. SPX does not provide advances, does not take possession or control of any music catalog or YouTube channel, holds no interest in any catalog or channel, and is never the counterparty on any funding agreement.

In this policy, "SPX", "we", "us" and "our" mean Social Playlist Ent LLC doing business as Social Playlist X. We operate the website at socialplaylistx.com and the application and referral process described on it.

Our funding partners provide the actual funding. At publication, those partners are: for music advances, Snafu (snafurecords.com) and Sound Royalties (soundroyalties.com); for YouTube advances, Viewture (viewture.com) and Sound Royalties (soundroyalties.com). The funding partner is the counterparty on all funding paperwork. Any advance, licensing arrangement or other funding agreement is between you and the funding partner, on terms set by that partner.

This policy does not describe the funding partners' privacy practices. Each partner has its own privacy policy, and we encourage you to read it before you sign any funding agreement.

We serve two groups of applicants: musicians (independent artists, producers and rights holders seeking funding against music catalog and streaming earnings) and YouTubers (monetized creators seeking funding against channel and advertising revenue). This policy covers personal information we collect through this website, our application and document submission process, email and other communications with us, and services that link to this policy. It does not cover the privacy practices of YouTube, Google, streaming services, distributors, social platforms, funding partners or other third parties. If you enter into a funding agreement with a funding partner, that agreement may contain additional privacy, data use and reporting terms. Where there is a conflict between that agreement and this policy, the agreement controls for the transaction it governs.

2.Information We Collect

We collect the information we need to run this website, qualify an application, refer a qualified applicant to a funding partner, and process platform usage fees. The categories below follow the California Consumer Privacy Act as amended by the California Privacy Rights Act (together, the "CCPA").

Information you give us directly

  • Identity and contact details: your name, stage or channel name, email address, phone number, mailing address and preferred contact method.
  • Applicant lane and catalog or channel details: whether you are applying as a musician or a YouTuber, and basic details about your catalog, masters, channel and audience.
  • Earnings documentation: royalty statements, streaming and platform analytics, channel and advertising revenue reports, and similar earnings records you submit so we can qualify your application.
  • Rights documentation: documents that help establish ownership and payment rights, such as split sheets, catalog or rights summaries, distribution or publishing information, and channel ownership information.
  • Billing and payment information: information needed to process your platform usage fee, such as payment card details, billing address and transaction records. We do not store full payment card numbers on our own systems — payment processing is handled by our third-party payment processor. See Section 5. Do not send payment card numbers or bank credentials through ordinary email.
  • Verification and tax information: identity verification and tax information, only at the stage where they are needed. Do not send government identification numbers, bank credentials or platform passwords through ordinary email. We will direct you to a secure submission method when one is required.
  • Communications: the contents of messages you send us, including application notes, questions and support requests, and — where we record calls and the law permits — call recordings and notes.

Information from accounts and sources you authorize

With your direction or authorization, we may receive information from streaming services, distributors, performing rights organizations and other platforms or representatives you ask to share records with us. This can include stream counts, revenue and payout history, catalog performance, and rights or ownership records. You can withdraw that authorization at the platform or by contacting us (see Section 10). Withdrawing authorization may prevent us from completing qualification or making a referral that depends on that information.

For the YouTube lane, SPX does not collect your Google or YouTube channel credentials or data. If you proceed with Viewture, you grant read-only access to your Google and YouTube channel data directly to Viewture through Viewture's own authorization flow. SPX is not a party to that authorization. See Sections 5 and 14.

Information collected automatically

  • Device and usage data: IP address, browser and device type, operating system, referring pages, pages viewed, and the dates, times and duration of visits.
  • Cookies and similar technologies: information stored in cookies and similar technologies. See Section 7.
  • Approximate location: general location inferred from an IP address, at the city or region level. We do not collect precise geolocation through this website.

Information from other sources

Where needed to qualify an application or protect the referral process, we may receive information from your authorized representatives, identity verification and fraud prevention providers, and public sources such as public catalog, chart or channel information. We combine information from these sources with what you provide to assess earnings, rights and eligibility for referral.

Sensitive personal information

In limited circumstances, we may collect sensitive personal information as defined by the CCPA — for example, a government identification number or financial account information used for identity verification or payment processing. We collect and use that information only to verify identity, process payments you owe for SPX services, prevent fraud, complete a referral you requested, comply with the law, or for another purpose permitted by the CCPA and its regulations. We do not use sensitive personal information to infer characteristics about you, and we do not sell it. See Section 11 for your right to limit certain uses.

We do not knowingly collect the categories marked as not collected below. If our practices change, we will update this disclosure before collecting a new category for a new purpose.

3.How We Collect Information

  • Directly from you, when you fill in an application, upload documents, email us or call us.
  • Automatically from your browser or device as you use the website, through cookies and similar technologies.
  • From platforms and representatives you authorize to share records with us.
  • From identity verification, fraud prevention and public sources, where needed to qualify an application.
  • From third-party advertising and analytics providers, where you have permitted the technologies described in Section 7.

4.How We Use Information

We use personal information to:

  • Run, maintain and secure this website.
  • Review and qualify your application, and assess earnings, rights and eligibility.
  • Refer a qualified applicant to a funding partner, and support that referral through to a funding decision.
  • Process platform usage fees and keep related billing records.
  • Communicate with you about your application, your referral and our services.
  • Detect, prevent and investigate fraud, abuse and security incidents.
  • Comply with legal, tax, accounting and regulatory obligations.
  • Measure the performance of our advertising, where you have permitted the technologies described in Section 7.
  • Improve our website and services, using aggregated or de-identified information where possible.

5.How We Disclose Information

We disclose personal information to:

  • Funding partners: Snafu and Sound Royalties for music advances; Viewture and Sound Royalties for YouTube advances — so a qualified applicant can be reviewed for funding. The funding partner is the counterparty on all funding paperwork.
  • Service providers: identity verification and fraud prevention providers, our payment processor, hosting and communication providers, and professional advisers who work under contract and may use the information only to provide their service to us.
  • Advertising providers: Meta (Facebook and Instagram), to measure the results of our advertising, where you have permitted the advertising technology described in Section 7.
  • Authorities and other parties: where required by law, to enforce our agreements, to protect the rights, property or safety of SPX, our applicants or others, or in connection with a corporate transaction.

Fees and compensation. SPX charges creators a platform usage fee for its qualification and referral services. This is the only fee a creator pays to SPX. The fee schedule is set out in the SPX Terms of Use or the applicable service agreement. Separately, SPX receives a referral commission from the funding partner when a referral results in funding. That commission does not reduce the creator's advance and does not come out of the funded amount.

6.Sale, Sharing, and Targeted Advertising

We do not sell your personal information for money. We do not share your application documents, earnings documentation or rights documentation for advertising purposes.

When you permit the advertising technology described in Section 7, the advertising provider may use information collected on this site to measure our advertising and to show relevant ads. Under the CCPA, some of that activity can count as "sharing" for cross-context behavioral advertising, even where no money changes hands.

You can refuse or withdraw that permission at any time, and we honor Global Privacy Control (GPC) signals your browser sends. To change your choice, use the control. SPX does not use or disclose sensitive personal information for purposes beyond those permitted by the CCPA.

7.Cookies and Tracking Technologies

We use cookies and similar technologies for essential functions and — with your permission, where the rules that apply to your region require it — to measure the results of our advertising.

Advertising

Our advertising provider is Meta (Facebook and Instagram). Meta sets its own cookies, including _fbp, to identify a browser across visits. This technology loads only where the rules for your region allow it, and only after you accept where permission is required.

Essential

Some cookies and storage are essential to run the site and keep your submission secure — for example, the security check on our application forms. These do not need your permission because they do not track you across other sites. The platform's own page statistics are counted without cookies and without identifying you.

8.Data Retention

We keep personal information for as long as we need it for the purposes described in this policy — to assess and process your application and any referral, to keep billing and transaction records, to meet legal, tax and accounting requirements, to resolve disputes, and to enforce our agreements. When we no longer need it, we delete it or de-identify it.

Retention periods differ by type of information and by the law that applies. Funding partners and other recipients keep information under their own retention practices, described in their own policies.

9.Data Security

We use administrative, technical and physical safeguards designed to protect personal information against unauthorized access, loss, misuse and alteration. These include encryption in transit, access controls and secure submission methods for sensitive documents.

No method of transmission or storage is completely secure, and we cannot guarantee absolute security. Please do not send government identification numbers, bank credentials or platform passwords through ordinary email — we will tell you how to submit sensitive documents securely if they are required.

10.Your Choices and Controls

You can:

  • Accept, refuse or change your cookie and advertising choices at any time, using the Cookie settings control.
  • Withdraw an authorization you gave to a platform or representative to share records with us, at the platform or by contacting us. This may prevent us from completing qualification or making a referral that depends on that information.
  • Ask us for access to, correction of, or deletion of your personal information, subject to the law and to records we must keep.
  • Opt out of marketing communications, though we will still contact you about an active application or referral.

11.California Privacy Rights (CCPA and CPRA)

If you are a California resident, you have the right to know what personal information we collect, use and disclose; to access and correct it; to delete it, subject to exceptions; to opt out of the sale or sharing of personal information; to limit the use and disclosure of sensitive personal information; and not to be discriminated against for exercising these rights. You may also authorize an agent to make a request on your behalf.

We do not sell personal information for money. Where our advertising technology counts as "sharing" under the CCPA, you can opt out using the control, and we honor GPC signals. We do not use or disclose sensitive personal information beyond the purposes the CCPA permits without a right to limit.

12.Privacy Rights in Other U.S. States

Residents of certain other U.S. states have similar rights to those described in Section 11 — including the right to access, correct and delete personal information, to opt out of targeted advertising, and to appeal a decision we make about a request — under the law of the state where they live. To make a request, contact us using the details in Section 17.

13.Children and Teens

This website and our services are for people who can enter into a funding agreement, and are not directed to children. We do not knowingly collect personal information from children under 16. If you believe a child has given us personal information, contact us using the details in Section 17 and we will delete it.

14.Third-Party Links and Platform Data

This website links to third-party sites and platforms, including our funding partners and streaming and social platforms. We are not responsible for their privacy or security practices, and linking to them does not imply endorsement.

For the YouTube lane: SPX does not collect your Google or YouTube credentials or data, does not connect to your YouTube channel, and does not control Viewture's access. If you authorize Viewture, you do so in Viewture's own flow, and that access is governed by Viewture's privacy policy and your Google Account permissions. You can review and revoke Viewture's access at any time in your Google Account permissions or through Viewture. Revoking access stops future transfers from the platform to Viewture but does not delete information already received. To request deletion, contact Viewture for its records and contact SPX for SPX-held records. See Sections 5 and 10.

15.U.S. Processing and International Visitors

SPX is based in the United States (Florida) and we process and store personal information in the United States. If you visit this website or submit an application from outside the United States, your information will be transferred to and processed in the United States, whose privacy laws may differ from those in your country.

Where required, we will rely on an appropriate transfer mechanism and respond to rights requests under the law that applies to you. Contact us at info@thesocialplaylist.com with any such request.

16.Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, funding partners or legal obligations. When we do, we will post the updated policy on this page and change the "Last updated" date at the top. If a change is material, we will provide additional notice where the law requires it — for example, by posting a prominent notice on the website or by emailing applicants with an active application.

Your continued use of the website after an update takes effect means the updated policy applies to information collected after that date, and where the law permits, to information collected earlier.
